Example Calculation: A screenshot of a complete recipe page containing 500 words, 3 images, 1 recipe, and ingredient cost data would result in liquidated damages of: £750 (text) + £825 (images) + £400 (recipe) + £240 (cost data) = £2,215.00 GBP. If used commercially, this amount is tripled to £6,645.00 GBP.

4.7 Legal Enforcement

These liquidated damages represent a reasonable pre-estimate of our actual losses from unauthorized use, including:

• Loss of traffic and advertising revenue
• Diminished SEO rankings due to duplicate content
• Cost of recipe development, testing, and photography
• Brand reputation damage
• Legal costs of enforcement

By using this website, you agree that these amounts are fair, reasonable, and not punitive. We reserve the right to pursue additional remedies available under Isle of Man law, including but not limited to injunctive relief, statutory damages, and actual damages exceeding the liquidated amounts where applicable.

4.8 How to Obtain Permission

4.9 Payment Terms and Debt Recovery

4.9.1 Payment Due Date

Upon notification of unauthorized use, liquidated damages become immediately due and payable. You agree that:

• Payment is due within seventy-two (72) hours of receiving invoice or demand letter
• The invoice may be sent via email, registered post, or any other verifiable communication method
• Payment must be made in British Pounds Sterling (GBP) to the account specified in the invoice
• Failure to pay within 72 hours constitutes a breach of these Terms and triggers additional remedies

4.9.2 Late Payment Interest

Any amount not paid within the 72-hour period shall accrue interest at the rate of 8% per annum above the Bank of England base rate (calculated daily), compounded monthly from the due date until payment in full. This interest provision complies with the Late Payment of Commercial Debts (Interest) Act 1998 as applied in the Isle of Man.

4.9.3 Debt Collection and Recovery Rights

You expressly acknowledge and agree that Andy's Pie: Pantry Tips has the unrestricted right to pursue all lawful means of debt collection and recovery, including but not limited to:

• Debt Collection Agencies: Engaging professional debt collection agencies or solicitors to recover the debt on our behalf
• Legal Proceedings: Initiating court proceedings in the Isle of Man or any other competent jurisdiction for recovery of the debt, interest, and costs
• Credit Reporting: Reporting the debt to credit reference agencies, which may adversely affect your credit rating and ability to obtain credit
• Assignment of Debt: Selling, assigning, or transferring the debt to third-party debt purchasers or collection agencies, who will have the same rights to pursue recovery
• Enforcement Actions: Once judgment is obtained, pursuing enforcement through bailiffs, attachment of earnings, charging orders, or other legal remedies available under Isle of Man law
• Cross-Border Recovery: Pursuing recovery in your jurisdiction of residence if different from the Isle of Man, including registering foreign judgments

4.9.4 Recovery Costs

You agree to reimburse Andy's Pie: Pantry Tips for all reasonable costs and expenses incurred in collecting the debt, including but not limited to:

• Legal fees and solicitors' costs (on an indemnity basis where permitted)
• Court fees, filing fees, and other litigation costs
• Debt collection agency fees and commissions
• Bailiff or enforcement agent fees
• Costs of tracing your whereabouts or assets
• Administrative costs of debt recovery (minimum £150.00 GBP)
• Expert witness fees for establishing damages
• Costs of registering or enforcing judgments in foreign jurisdictions

4.9.5 Assignment and Transfer of Rights

Andy's Pie: Pantry Tips reserves the absolute right to assign, transfer, sell, or otherwise dispose of any debt arising from these Terms to any third party without your consent or prior notice. Upon such assignment:

• The assignee shall have all rights to pursue recovery as if they were the original creditor
• You shall have no right to object to or challenge the assignment
• You must make payment to the assignee as directed
• The assignee may pursue any and all remedies available under these Terms

4.9.6 Waiver of Defenses

By accepting these Terms, you expressly waive any right to contest or defend against the debt on the following grounds:

• That you were unaware of the liquidated damages provisions
• That the amounts are excessive or unreasonable (having agreed they are fair and reasonable)
• That you did not intend commercial use (intent is not required for liability)
• That the debt has been assigned to a third party

You acknowledge that your use of this website constitutes acceptance of these payment and collection terms, and that digital records of your access (IP address, timestamps, content accessed) serve as prima facie evidence of your agreement.

4.9.7 Jurisdiction for Debt Recovery

While these Terms are governed by Isle of Man law, Andy's Pie: Pantry Tips reserves the right to pursue debt recovery in:

• The courts of any jurisdiction where you hold assets
